Miss Briscoe, 56, is accused of providing officers with inaccurate information after a newspaper revealed that the disgraced former Cabinet Minister had forced his former wife to take his penalty points so he would not lose his driving licence.

The high-profile barrister and part-time judge was arrested by Kent Police last year and twice interviewed under caution.

However, a decision on whether to charge her had to wait until the end of the trial of Huhne, 58, and his ex-wife, Vicky Pryce, 60.

Miss Briscoe is accused of providing Essex Police with two inaccurate statements between May 16 2011 and October 6 2012.

She is also alleged to have produced a copy of a witness statement on October 6 2012 that had been altered and that she maintained was the correct version.
